04 Tax Services

Proficient in Federal Tax and Corporate Structuring

Aerlex offers tax advice and planning to strategically address all aspects of the federal, state and local taxation issues that can arise in connection with the purchase, lease, or sale of an aircraft.

Satisfying IRS and FAA considerations — reviewing ownership structures to avoid an illegal "flight department company" and minimize federal excise tax exposure.
Bonus depreciation — guidance on qualifying acquisitions and avoiding recapture of accelerated depreciation.
Personal use of aircraft and deductibility — valuing non-business flights, limiting personal use.

05 Litigation

Wise Counsel for Complex Litigation Matters

Aerlex Law grew out of an aircraft insurance defense practice more than 20 years ago; attorneys provide decades of experience in all areas of aviation litigation, representing clients in federal and state courts, before governmental agencies, and in arbitration and mediation.

Business and commercial disputes, employment, real estate and construction litigation, insurance coverage and liability defense.
Representation of aircraft owners, insurers, operating companies, FBOs, manufacturers, and Part 121/135/145 certificate holders.
Aircraft repossession for lenders and enforcement of aircraft liens for repair stations, FBOs and owners.
Employment defense — discrimination and wrongful termination claims.

06 FAA & Regulatory Law

50 Years of Experience in Aviation Regulatory Law

Aerlex has unparalleled proficiencies in aviation regulatory law — a critical skillset as aviation is one of the most heavily regulated industries at the Federal level (FAA safety oversight; DOT economic regulation).

Combined 50+ years representing major airlines (US and foreign), business aircraft owners, service providers, pilots and mechanics — enforcement matters, certification, U.S. citizenship issues, accidents.
One specialist served on the FAA committee that wrote the rules for aircraft fractional ownership, and on a committee suggesting changes to air carrier/commercial operator rules; also a founding member and Chairman of the NBAA Tax Committee.
Aviation Certification & Compliance Consultant is a former FAA inspector and ATP-rated pilot with senior airline management experience.

07 International Registry

Efficient Registry of International Aircraft and Mobile Assets

The International Registry of Mobile Assets (IR) provides a means for establishing priority interests in airframes and engines under the Cape Town Convention and Aircraft Protocol (adopted Nov 1, 2001, Cape Town, South Africa), with priority on a first-to-file basis.

Qualifying aircraft objects — airframes (8+ persons or 2,750kg+ goods), helicopters (5+ persons or 450kg+ goods), jet engines (1,750+ lbs thrust), turbine/piston engines (550+ shaft horsepower).
Lending requirements — buyers and sellers must obtain an IR user license and consent to registration at funding/closing.
Aerlex has submitted hundreds of IR user license applications and acts as Administrator for many clients.
